Welcome to Alex Fitness Studio ("Alex Fitness Studio," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of this website and the personal training services described on it. By submitting the inquiry form or booking a session, you agree to these Terms.
Alex Fitness Studio provides 1:1 in-person and virtual personal training services. Session availability, pricing, and program details are as described on this website and may be updated from time to time. Nothing on this website is a guarantee of specific results.
Sessions are booked directly with Alex following an initial consultation. Cancellations or reschedule requests should be made at least 24 hours in advance whenever possible. Late cancellations or missed sessions may be subject to a cancellation fee, at Alex's discretion, communicated to you at the time of booking.
Session rates are as quoted at the time of booking. Payment is due as agreed between you and Alex prior to or at the time of each session, unless a different arrangement (such as a package or membership) has been agreed to in writing.
Physical training carries inherent risk of injury. By participating in any session, you acknowledge that you are voluntarily participating in physical exercise and assume all risks associated with that participation, known and unknown, including but not limited to the risk of physical injury. You confirm that you have no medical condition that would make physical exercise unsafe for you, or that you have consulted a physician and been cleared to participate.
To the fullest extent permitted by law, you knowingly and voluntarily release, waive, and discharge Alex Fitness Studio, its owner, and any affiliated trainers from any and all liability, claims, or causes of action arising out of the negligence of Alex Fitness Studio, its owner, or any affiliated trainers, in connection with your participation in training services — except for liability arising from gross negligence or willful misconduct, which cannot be waived under New York law and is not released by this Section.
New York-specific note: New York General Obligations Law § 5-326 voids liability waivers used by fee-based pools, gymnasiums, and similar recreational facilities. New York courts have distinguished this from businesses whose primary purpose is one-on-one instruction rather than open recreational access — for example, Hsu v. Krav Maga NYC, LLC, 138 A.D.3d 424 (1st Dep't 2016), and Kim v. Hanson Place Fitness (N.Y. Sup. Ct. Kings Cnty. 2014) — on the reasoning that the fee paid is for instruction, not facility access. A solo, appointment-based personal training business like this one fits that instructional pattern more than it fits a gym-membership pattern, which is why this waiver has a reasonable basis, but I can't independently confirm it holds up in every situation — that depends on specific facts (including where sessions actually take place: your own studio space, a gym you rent from, or a client's home) that only a New York attorney reviewing your actual setup can evaluate. In Kim, the court also found the waiver language itself needed to clearly and specifically address negligence to be enforceable, which is why the paragraph above states "negligence" explicitly rather than using only general release language.
Nothing provided through this website, the inquiry form, or any training session is intended as medical advice. Alex Fitness Studio is not a substitute for consultation with a licensed physician or other qualified healthcare provider. Always consult your doctor before beginning any new exercise program, especially if you have an existing medical condition, injury, or are pregnant.
The inquiry form on this website may ask you to share health-related information (such as injuries or physical limitations) so that training can be tailored safely to you. This information is used only to plan and deliver your training and is not sold or shared with third parties for marketing purposes. You may ask, at any time, what information is on file for you and request that it be corrected or deleted.
As a New York business handling private information electronically, Alex Fitness Studio maintains reasonable administrative, physical, and technical safeguards for information collected through this site, consistent with New York's Stop Hacks and Improve Electronic Data Security (SHIELD) Act. In practice, this means limiting who can access inquiry submissions, not retaining old inquiries longer than needed, and relying on Netlify's secured form storage rather than exporting data to less secure locations.
All content on this website, including text, photos, and the Alex Fitness Studio name and logo, is the property of Alex Fitness Studio and may not be copied or used without permission.
To the fullest extent permitted by law, Alex Fitness Studio is not liable for any indirect, incidental, or consequential damages arising from your use of this website or participation in training services.
These Terms may be updated from time to time. Continued use of this website or ongoing participation in training services after changes are posted constitutes acceptance of the updated Terms.
Questions about these Terms can be sent through the inquiry form on the homepage.
This page has been drafted with New York law specifically in mind (see the note in Section 4 on General Obligations Law § 5-326), but it is still a general template written by an AI assistant, not a licensed attorney, and has not been reviewed by one. I'm reasonably confident the overall structure is sound and that Section 4 reflects real, current New York case law as I found it — but "reasonably confident" is not the same as legal certainty, court rulings are fact-specific, and I can't verify how a court would treat your specific setup. Before this goes live, it's worth having a New York attorney (or, at minimum, a reputable template service such as Termly or TermsFeed) review it — particularly Sections 4 and 6.
